En el estudio que aquí se presenta se analiza hasta qué punto se puede llegar a una situación democrática estable, siguiendo los planteamientos del Cesarismo Democrático de Laureano Valenilla Lanz, que para conseguir los objetivos utilitaristas señalados por Simón Bolívar en su Manifiesto de Cartagena, intentó construir un sistema autoritario de gobierno. En contra de los razonamientos expresados por el autor venezolano, y desde una óptica más actual, hablar de democracia no supone quedarse en la mera constatación de las realidades (...) concretas, sino hacerlo desde una perspectiva de deber ser. Aceptar los hechos tal y como son, tiene como consecuencia teórica la ausencia de criterio demarcador que oriente la política concreta y, cómo no, la labor intelectual. Entre los objetivos de estas páginas resaltan dos: la democracia se refuerza con un mayor grado de democracia; y que la lucha por las condiciones económicas, sociales o laborales, no puede ser desgajada de la pugna política por conseguir cada vez mayores espacios democráticos, tanto en la sociedad como en el Estado. The aim of this research is to develop and validate a measurement scale for consumer’s perceptions of corporate social responsibility using the three-dimensional social, environmental and economic conceptual approach as a theoretical basis. Based on the stages of measurement scale creation and validation suggested by DeVellis and supported by Churchill Jr.’s :64–73, 1979) suggestions, five different empirical studies are developed expressly and applied to consumers of tourist services. This research involves 1147 real tourists from 24 countries in two different cultural (...) and geographical contexts. A three-dimensional 18-item scale is proposed for measuring consumer perceptions of corporate social, environmental and economic responsibilities. International business enterprises face a number of ethical issues when conducting business in unfamiliar parts of the world, especially in places wherecorruption is deeply rooted. This is the situation in Latin America - a highly heterogeneous region characterized by cultural complexity, inconsistencies, andcontradictions at multiple levels of society, with implications for business ethics that are potentially as troubling to outsiders as they are opaque.We briefly indicate the relevant academic literature on this subject, noting that studies of business ethics in Latin (...) America are surprisingly sparse, fragmented, and uneven in comparison with the abundance of published research on business ethics and values in other world regions. Given the importance of Latin American markets, production capacity, raw materials, and economic growth, we identify this situation as a challenge and opportunity for business ethics researchers. Examination of these issues contributes new information and insight into the realities of doing business in emerging market countries and is critical on a theoretical as well as a practical level. This paper describes a novel diagramming technique that we have found useful for highlighting differences in the work values of countries located within a single cultural region, followed by a brief demonstration of its application to countries in two regions (Latin America and the Mediterranean) with regard to managing corruption. We also indicate a few of the various ways that this technique can be used, such as to identify similarities between countries that are not in the same cultural region, yet (...) have one or more important cultural characteristics in common which set them apart from others in their respective regions.The paper directs attention to the practical and theoretical significance of intra-regional cultural differences that may be taken for granted by insiders to the region, while being overlooked by others. We hope that the introduction of this diagramming technique will stimulate further conceptual and empirical exploration of the potential significance of intra-regional cultural differences for international business ethics, as a preliminary step towards development and delivery of organizational interventions to manage the ethical frictions generated by critical differences in beliefs, attitudes, norms and values internationally. One of the most important contributions of Einstein to the philosophy of science is the distinction between two types of scientific theories: ‘principle’ and ‘constructive’ theories. More recently, Flores proposed a more general distinction, classifying scientific theories by their functional role into ‘framework’ and ‘interaction’ theories, attempting to solve some inadequacies in Einstein’s proposal. Here, based on an epistemic criterion, we present a generalised distinction which is an improvement over Flores approach. In this work (i) we evaluate the (...) shortcomings related to Flores’s proposal, (ii) we present an epistemological criterion that opens the door for a more general classification of any scientific theory in all of the natural science into two distinct groups, which we call ‘mechanistic theories’ and ‘structural theories’, and (iii) we show that such a criterion is connected to Flores’ proposal while overcoming issues of all previous approaches. In this paper, we argue that there are epistemic norms on evidence-gathering and consider consequences for how to understand epistemic normativity. Though the view that there are such norms seems intuitive, it has found surprisingly little defense. Rather, many philosophers have argued that norms on evidence-gathering can only be practical or moral. On a prominent evidentialist version of this position, epistemic norms only apply to responding to the evidence one already has. Here we challenge the orthodoxy. First, we argue that (...) there is no significant normative difference between responding to evidence you have and gathering more evidence. Second, we argue that our practices of epistemically criticizing agents for their poor evidence-gathering indicate the existence of epistemic norms on evidence-gathering. Finally, we show that our thesis has important implications for recent debates about the relationship between epistemic norms and inquiry. (shrink)

Background:Decision-making and assessment in emergency situations are complex and result many times in ethical conflicts between different healthcare professionals.Aim:To analyse and describe situations that can generate ethical conflict among nurses working in emergency situations.Methods:Qualitative analysis. A total of 16 emergency nurses took part in interviews and a focus group.Ethical considerations:Organisational approval by the University Hospital, and informed consent and confidentiality were ensured before conducting the research.Result/conclusion:Two categories emerged: one in ‘ethical issues’ and one in ‘emotions and feelings in caring’. The (...) four ethical subcategories are presented: Autonomy, the first sub category: first, the nurse’s ability to practise care on an emergency ward and, second, to support the patient and/or relatives in terms of care and medical treatment. The conflicts arise when the nurse ends up in the middle between the patient and the physician responsible for the diagnosis and treatment from a nature scientific perspective. Reification of injured body: patient was often reified and fragmented, becoming just a leg or arm. Different factors contributed in this perspective. Pain: pain relief was often inadequate but more effectively treated in the emergency medical services than at the emergency department. The nurses highlighted the phenomenon of suffering because they felt that pain was only an object, forgetting the patients’ care need, like separating mind from body. Death: the nurses felt that the emergency services are only prepared to save lives and not to take care of the needs of patients with ‘end-of-life’ care. Another issue was the lack of ethical guidelines during a cardiac arrest. Resuscitation often continues without asking about the patient’s ‘previous wishes’ in terms of resuscitation or not. In these situations, the nurses describe an ethical conflict with the physician in performing their role as the patient’s advocate. The nurses express feelings of distress, suffering, anger and helplessness. (shrink)

1. Two Approaches to the EarthIn several postwar texts, the earth increasingly receives attention from Carl Schmitt.1 In The Nomos of the Earth, the most important of these texts, he refers to Friedrich Hölderlin, a much earlier, very different author, who also considers the subject of the earth. Even though the positions of both are, ultimately, quite similar, they maintain significant terminological differences. Schmitt and Hölderlin both employ the word “nomos,” but in very different ways. Hölderlin regards “nomos” as “law” (...) in the sense of “positive” norm or “Gesez.”2 This use of “nomos” as “Gesez” differs from a second notion of law as the meaning operating at the basis of what Hölderlin calls the “sphere.” The sphere is a meaningful whole in which man originally exists. Law is here the very relations of the sphere as a meaningful whole. Hölderlin calls it the law in a “negative” sense.3 This second notion of law by Hölderlin (negative law or law as the meaning at the basis of the sphere) coincides precisely with the Schmittian idea of “nomos” as an “order of meaning [Sinnreich],”4 what he also calls the law in an “ontonomous and existential” sense.5 The first use of law as “nomos” or “Gesez” by Hölderlin coincides with Schmitt’s use of “Gesetz”: of law as “positive” law. La libertad tiene un valor sistemático fundamental en la filosofía de Kant. En la filosofía práctica, ella es condición de la acción en sentido eminente. Tanto en la _Fundamentación de la metafísica de las costumbres_, cuanto en la _Crítica de la razón práctica_, Kant intenta probar la libertad. La argumentación en ambas obras es distinta. El presente trabajo hace foco especialmente en la justificación de la segunda _Crítica_. En ella, Kant plantea que de la libertad sabemos gracias al hecho de (...) la consciencia moral o de una ley que vincula al sujeto incondicionadamente. Se intentará mostrar, a partir de una consideración de los textos de Kant, las obras de algunos intérpretes, así como en una reflexión sistemática, que la libertad, y el hecho de la consciencia moral, requieren de un acceso a la espontaneidad práctica por parte del sujeto, asunto que Kant deja sugerido en algunos pasajes. Friedrich Hölderlin argued that consciousness requires division and unity. Consciousness emerges through the fundamental distancing of the subject from its surroundings, without which the subject-object distinction would collapse and both objectivity and consciousness would be lost. Nevertheless, insofar as conscious knowledge is unitary, division demands a ground for unity. Hölderlin calls this ground ‘Being [Seyn].’ However, once Being is affirmed, the question of how it is accessed arises. Hölderlin’s scholars disagreed on this issue. This disagreement gave rise to two camps: (...) those who deny that Hölderlin accepts the idea of direct access to Being and believe that he proves Being through an act of reflection (Henrich); and those who argue that for Hölderlin, ‘Being’ is directly accessed. Those who hold the latter position can be further divided into those who conceive of this direct access as knowledge (Frank) and those who argue that this access does not have a cognoscitive character, but rather an aesthetic one (Waibel). This article considers these positions and shows that the direct apprehension of ‘Being’ is part of Hölderlin’s argument aimed at solving a fundamental problem; an argument that differs both from the postulate of access to Being as knowledge of transcendence and from the affirmation of a purely aesthetic mode of access. In this article, I offer a methodological analysis of the empirical research on the causal effects of trade liberalisation, and assess whether such studies can be of any use for guiding policy prescriptions in real-world economies. The analysis focuses on the mainstream economic research that has been used to support arguments in favour of trade liberalisation during the last decades. Even though there are empirical results that could be taken as valid evidence for a causal connection between free trade and (...) economic gains, none of the existing evidence licences trustworthy inferences about the policy effectiveness of trade liberalisation reforms in real-world cases. There are three aspects of the empirical literature that make it highly problematic for making reliable policy inferences: (a) the criteria used to define the notion of ‘free trade’, (b) the background assumptions embedded in the econometric techniques used for estimating causal effects, and (c) the widespread desire among academic economists to attain scientific results in terms of universally valid generalisations. The analysis exposes a worrisome mismatch between, on the one hand, the research aims and outcomes of scientific economics and, on the other, the kind of evidence that would be useful for guiding actual policy deliberations. Friedrich Schleiermacher is among the philosophers who influenced Karoline von Günderrode's thought. Although this influence is relevant, it has received little attention. Both authors agree on distinguishing “spirit” and “body” or “the inner and the outer” in similar terms. However, there was a significant difference between them. In Schleiermacher's works that Günderrode considered (On Religion and Soliloquies), he conceives of the relationship as one in which the world or outer depends on the spirit or inner. For Günderrode, this relationship is (...) polar, as “spirit” and “world” form part of an original totality. This difference from the philosopher influences the issue that both raised of access to the “primordial ground.” For Schleiermacher, the world depends on spirit; the issue of access to that foundation is circumscribed to access to the spiritual dimension. In contrast, for Günderrode, “spirit” and “body” are poles of a previous original totality. Hence, access to the primordial ground does not coincide with the spirit's access to itself. Instead, access to unity is both spiritual and corporeal. Günderrode's differences from Schleiermacher are based on an argument we attempt to elucidate and evaluate in this article. (shrink)

L’enfant placé a souvent vécu des traumatismes qui ont impacté sa capacité à réguler ses émotions dans les relations interpersonnelles. Afin d’aider les assistants familiaux et les parents à mieux s’ajuster à l’enfant ont été instaurés des temps d’observation dans les conditions naturelles des interactions adulte-enfant qui ont été enregistrés en vidéo. Le vidéo-feedback a ensuite été utilisé avec chacun des adultes. L’exemple de Matthias montre comment ce dispositif a permis aux parents d’identifier les conséquences de leur comportement sur leur (...) enfant. L’exercice a été plus difficile pour l’assistante familiale davantage centrée sur ses besoins. (shrink)

This research was carried out in a classroom of the center of comprehensive family development in the municipality of Durango, Mexico. The center trains young people in making crafts. From these young people, 13 teenage mothers ages 15-23, all victims of abuse as children, were selected. With this group, we implemented the philosophical-pedagogical proposal called "Philosophy for children and teenagers," first developed by the American philosopher Matthew Lipman. The main goal was to form a "community of inquiry," where through philosophical (...) dialogue the participants developed cognitive skills, allowing them to share, in an ethical and moral dialogue, their life experiences within a democratic setting. The results were demonstrated through the disclosures made by the participants during the philosophical dialogues, We also recorded the cognitive abilities detected over 20 sessions. We contrast the results with the theories to demonstrate the participants’ cognitive changes. We also observed unexpected findings in other academic fields that facilitate ethical and moral thinking. Resumen El propósito de este trabajo es profundizar en el concepto de actividad de imagen y defender su utilidad como categoría de estudio para comprender diferentes tipos de comportamiento que afectan a la imagen social de los hablantes en la interacción comunicativa: cortesía, descortesía y actividad de autoimagen. Teniendo como base estudios sociopragmáticos del español desde una perspectiva cultural y estudios teóricos en inglés de la última década, se tratará el concepto de actividad de imagen, el cual se caracteriza de (...) acuerdo con dos conceptos claves: el del efecto social que un comportamiento comunicativo tiene sobre las imágenes de los hablantes y el del continuo social, la conexión que se establece entre sus imágenes en la interacción. De esta forma, se propone tratar la actividad de imagen desde dos perspectivas relacionadas: la de la dirección seguida por el efecto social hacia los interactuantes y la de las características de este efecto, siendo su interrelación el factor que permite identificar y caracterizar el tipo de actividad de imagen. En el presente trabajo pretendo mostrar que el pensamiento de Carl Schmitt tiene un carácter marcadamente filosófico. Más precisamente: que en la base de él se halla una teoría de la comprensión. Esa teoría de la comprensión tiene la particularidad de que se desarrolla a partir de una teoría de la comprensión jurídica, pero se extiende, en su obra, a la comprensión en general.
